Beyond Wine Data Use License
Version 1.0 — effective 2026-05-29
1. Definitions
- “Beyond Wine,” “we,” “us” — Lyssa Ventures LLC, a Florida (USA) limited liability company, operator of beyond.wine and app.beyond.wine.
- “Licensed Material” — the material we own or have the right to license: our original selection, arrangement, and structuring of the database; our claim annotations, confidence and verification signals, tags, and provenance graph; our original prose; our claim identifier system; and the presentation and organization of the API and pages. The EU sui generis database right in the Beyond Wine database, where it subsists, is part of the Licensed Material.
- “Facts” — the underlying factual information expressed in claims. Facts are not owned by us and are not Licensed Material.
- “Source Excerpts” — verbatim or near-verbatim quotations of third-party source text, surfaced as evidence supporting a claim and attributed to their source. Source Excerpts are third-party material, are not Licensed Material, and are not licensed under this License (see §5).
- “You” — any person or system that accesses the Content, including operators of crawlers, search indexes, retrieval systems, and AI/ML systems.
- “Content” — the Licensed Material, Facts, and Source Excerpts as served from beyond.wine, app.beyond.wine, the
/api/llm/*endpoints, the MCP server, and the published files. Only the Licensed Material is licensed under §2; your permission to access the Content does not by itself license the Facts or Source Excerpts within it (see §5).
2. Grant
Subject to §3 and §4, and to the extent we own or control the relevant rights in the Licensed Material, we grant you a worldwide, royalty-free, non-exclusive, non-transferable, non-sublicensable license to:
- Access, crawl, index, and cache the Content as served;
- Use the Licensed Material to train, fine-tune, evaluate, and ground AI systems, including building embeddings and retrieval indexes;
- Retrieve and use the Licensed Material at inference time to answer end-user queries;
- Quote and cite reasonable portions of the Licensed Material, with attribution as required by §3.
Technical copies. These permissions include the temporary, intermediate, and technical copies (including extraction and reproduction) reasonably necessary to perform the activities permitted in this §2 (for example, the copying inherent in crawling, indexing, caching, embedding, training, evaluation, and inference). This §2 does not authorize extraction or reproduction undertaken for any purpose reserved in §4. Facts and Source Excerpts are not licensed under this §2 (see §5).
3. Conditions
- Attribution. Where you surface or cite the Licensed Material to end users, credit “Beyond Wine (beyond.wine)” and, where practical, link to the relevant page or claim. The API exposes the authoritative attribution string in each response.
- Retain notices. Do not remove or obscure license, attribution, source, or provenance information.
- No misrepresentation. Do not imply that Beyond Wine endorses you or your output, or misstate a claim's confidence or verification status.
4. Reservations
All rights not expressly granted are reserved. Except for the technical copies permitted under §2, and without our prior written permission, you may not:
- Bulk-extract or reproduce a substantial part of the database (by volume or by value) for the purpose of any activity in items 2 or 3 below (including re-utilization of a substantial part of any EU sui generis database right);
- Redistribute, publish, sell, sublicense, or otherwise make available the Licensed Material or the database (or a substantial part) as a dataset, feed, dump, or download;
- Build, or use the Licensed Material to build, a competing or substitute database, directory, or product that reproduces or is primarily derived from the Beyond Wine database;
- Circumvent access controls, rate limits, or authentication;
- Remove, alter, or falsify attribution, source, or provenance information.
For clarity: training or grounding a general-purpose AI system is permitted under §2, including the technical copies that requires. What is reserved is extraction or reproduction of a substantial part of the database in order to redistribute it or to build a competing or substitute dataset or product.
5. What is NOT licensed
- Facts are free. You do not need this License to use the Facts. We assert no copyright in Facts. This License covers only the Licensed Material.
- Source Excerpts are third-party material, reproduced as short, attributed evidence under applicable quotation/fair-use rights. They are not licensed to you here; their rights remain with their original publishers.
- No trademark or name rights. Names, logos, marks, and trade dress of Beyond Wine and of the producers, beverages, people, and restaurants described are not licensed.
- Access is not a license to third-party material. Permission to access or use the website, API, or MCP server does not grant any license to the Facts or Source Excerpts beyond what their own rights (or absence of rights) permit. We license only the Licensed Material, and only to the extent we own or control it.
6. Changes and termination
- We may publish revised versions of this License with a new version number. Each published version is the standing offer for access under that version.
- We cannot un-train models. Permissions exercised before a change (for example, training already performed) are not retroactively revoked; this License does not purport to claw back lawful prior use.
- For API/MCP consumers, the operative version and acceptance are governed by the Terms of Use.
- We may suspend or terminate access (including API keys) for breach of §3 or §4.
7. No warranty; limitation of liability
THE CONTENT IS PROVIDED “AS IS,” WITHOUT WARRANTY OF ANY KIND. Claims carry confidence and verification signals but are not guaranteed accurate, complete, or fit for any purpose. To the maximum extent permitted by law, Beyond Wine disclaims all warranties and is not liable for any direct, indirect, incidental, or consequential damages arising from use of the Content.
8. Governing law
This License is governed by the laws of the State of Florida, USA, without regard to its conflict-of-laws rules. Venue for any dispute lies in the state or federal courts located in Florida, except where mandatory local consumer-protection law provides otherwise.
9. Bulk and commercial licensing
